Notice is hereby given that the District of Ucluelet Council proposes to adopt “District of Ucluelet Parkland Disposal Bylaw No. 1334, 2024”. The purpose of the Bylaw is to authorize the District to close a 0.201 hectare portion of parkland located in the northwest corner of Tugwell Field Park fronting Forbes Road and dispose of this closed park to the Food Bank on the Edge for $1.00.  The parkland to be closed and disposed of is outlined in bold and marked “Park to be Closed Parcel A”, on the map on the right.Map_-_Tugwell_-_AAP.jpeg

As additional consideration for the disposition of the closed park, the District will be granted:

  1. an option to re-purchase the closed Park exercisable by the District if the closed park is not used for the operation of a food bank for a consecutive period of six months, the owner fails to maintain the lands and the buildings on the land in a good state of maintenance and repair, or at any time following the 20th anniversary of registration of the option; and
  2. a statutory right of way entitling the District to store equipment and goods on the closed park. 

A copy of “District of Ucluelet Parkland Disposal Bylaw No. 1334, 2024”, this notice, and other related information is available at the District of Ucluelet Office at 200 Main Street, Ucluelet, BC, during regular business hours (8:30 AM to 4:00 PM, Monday to Friday, excluding statutory holidays) and on the District’s website at Ucluelet.ca/AAP.

Take further notice that the District of Ucluelet Council may proceed with the Bylaw unless by 4:00 PM on March 13, 2024, at least 10% of the electors in the whole District of Ucluelet indicate, by submitting a signed elector response form, that the District must obtain the assent of the electors by way of an assent vote (referendum vote) before proceeding with the Bylaw.

The area to which the alternative approval process applies is the entire area of the District of Ucluelet. Council has determined that the number of electors responses required to prevent the local government from proceeding without assent of the electors is 173. A report respecting the basis on which this determination was made, is available upon request from the District of Ucluelet.

DEADLINE:

The deadline for submitting an elector response form is 4:00 PM on March 13, 2024.

INSTRUCTIONS

If you are not opposed to the adoption of the above noted Bylaw, no action is required.

If you are opposed to the adoption of the above noted Bylaw without the Bylaw first receiving assent of the electors by assent voting (referendum vote), you may sign and submit an elector response form indicating your opposition.

A person may not sign more than one elector response form. 

Elector responses are required to be submitted to the local government on the form established by Council. These elector response forms are available at District of Ucluelet Office (also referred to as the Municipal Hall) during regular business hours or downloaded from Ucluelet.ca/AAP. The only elector response forms that will be accepted are the ones provided by the District of Ucluelet, or an accurate copy of the form.

 Elector response forms may be submitted by hand delivery to 200 Main Street, Ucluelet, BC, mail to District of Ucluelet, PO Box 999, Ucluelet BC, V0R 3A0, or by email to communityinput@ucluelet.ca.

QUALIFICATIONS FOR RESIDENT AND NON-RESIDENT PROPERTY ELECTORS

Only electors of the District of Ucluelet are eligible to sign the elector response forms. There are two types of electors – resident electors and non-resident property electors.

Resident Elector: When signing an elector response form during an Alternative Approval Process (AAP), a resident elector must: be at least18 years of age; be a Canadian citizen; have been a resident in British Columbia for at least six months; live in the District of Ucluelet; and, not be disqualified under the Local Government Act, or any other enactment from voting in a local election, or be otherwise disqualified by law.

Non-resident Property Elector: When signing an elector response form during an AAP, a non-resident property elector must: be at least 18 years of age; be a Canadian citizen; have been a resident in British Columbia for at least six months; have owned property in the District of Ucluelet for at least 30 days; and, not be disqualified under the Local Government Act, or any other enactment from voting in a local election, or be otherwise disqualified by law.

Note: Only one non-resident property elector may sign an elector response form per property, regardless of how many people own the property; and, that owner must have the written consent of a majority of the other property owner(s) to sign the response form on their behalf. Property owned in whole or in part by a corporation does not qualify under the non-resident property elector provisions.
